Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of Noveling Tracks (“the Service”), a writing-project management application provided by JtoN (“we”, “us”, or “our”). By creating an account, subscribing, or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Seller Information

The Service is operated by JtoN. You are contracting with JtoN for your use of the Service. For support or legal inquiries, contact us at support@novelingtracks.life.

3. Eligibility and Authority

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it updated. Notify us immediately if you suspect unauthorized access.

5. Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes, but is not limited to:

  • Using the Service for any unlawful purpose or in violation of applicable laws;
  • Uploading or transmitting content that infringes intellectual property rights;
  • Engaging in fraud, spam, phishing, or deceptive practices;
  • Attempting to interfere with the security, availability, or integrity of the Service, including probing, scraping, or introducing malware;
  • Reverse engineering, decompiling, or attempting to extract source code;
  • Reselling, redistributing, or sublicensing access to the Service;
  • Circumventing any usage limits or access controls.

6. Intellectual Property

JtoN retains all rights, title, and interest in and to the Service, including its software, designs, documentation, branding, and logos. Subject to these Terms and your active subscription or trial, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal or internal writing-project management purposes.

You retain ownership of the content you enter into the Service. You grant us a limited license to host, process, and display that content solely for the purpose of providing the Service to you.

7. Service Level

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted, error-free, or completely secure operation. The Service is provided on an “as is” and “as available” basis. Scheduled maintenance, updates, and factors beyond our control may affect availability.

8. Subscriptions, Payments, and Billing

Noveling Tracks is offered on a subscription basis. During the Beta period, pricing is discounted and will increase to the regular rate after April 2027, as described on the billing page and in-app notices.

Payments, billing, tax collection, subscription management, cancellation, and refunds are handled by Paddle, our online reseller and Merchant of Record. By completing a purchase, you acknowledge and agree that Paddle’s Buyer Terms apply to the payment and subscription mechanics. Merchant of Record disclosure: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides customer service inquiries and handles returns.

Subscriptions automatically renew for successive periods unless canceled before the next renewal date. You may cancel at any time through the billing page or Paddle customer portal. Cancellation takes effect at the end of the current paid period, and you will not be charged for the next period.

9. Beta Status

Noveling Tracks is currently in Beta. Features, pricing, and availability may change without notice. Beta pricing is offered at a discount and will transition to the standard rate after April 2027. We may limit sign-ups, modify functionality, or end the Beta program at our discretion.

10. Refunds

Refund requests are handled in accordance with our Refund Policy and Paddle’s refund policy. Please review the Refund Policy for details.

11. Termination and Suspension

We may suspend or terminate your access to the Service, with or without notice, if you materially breach these Terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously violate our acceptable-use policies.

Upon termination, your right to access the Service immediately ceases. We may delete or retain your data in accordance with our Privacy Notice and applicable law. You are responsible for exporting your data before cancellation if you wish to keep it.

12. Disclaimers

To the fullest extent permitted by law, JtoN disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that any errors will be corrected.

13. Limitation of Liability

To the fullest extent permitted by law, JtoN’s aggregate liability arising out of or relating to these Terms or the Service will not exceed the total amount you paid to use the Service in the twelve (12) months preceding the event giving rise to liability.

In no event will JtoN be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, goodwill, or business interruption, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability for fraud, death, or personal injury where required by law.

14. Indemnity

You agree to indemnify and hold harmless JtoN and its representatives from any claims, damages, or expenses arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Texas.

16. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

17. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, pandemics, or shortages of transportation, facilities, fuel, energy, labor, or materials.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
